What is a breach of contract in an employment contract?

A breach of contract in an employment contract happens when the employee or employer breaks one of the terms of the contract.

If an employer breaches the employment contract (e.g. does not pay the employee's wages), the employee should first try to resolve the problem with the employer. If the conflict is not resolved, the employer and employee should first go through mediation. If it is still not resolved, the employee can take legal action.

If an employee breaches the employment contract (e.g. quits without giving notice to the employer), the employer should first try to resolve the problem with the employee. If the conflict is not resolved, the employer can sue the employee for damages for financial loss.
