This LICENCE TO OCCUPY comprises the particulars detailed above and the terms and conditions below whereby the Property is licensed by the Licensor and taken by the Licensee for occupation during the Term upon making the Payment and paying the Deposit.

Terms and Conditions

  1. This Agreement is personal to the Licensee and is not assignable. It will automatically terminate, without notice, if the Licensee fails to make two or more payments which have become due, whether formally demanded or not, or the Licensee ceases to reside at the Property.
  2. The Licensee agrees:
    1. to make all payments on time and in the manner specified, without any deduction or abatement;
    2. to keep the Property in a clean and tenantable state at all times;
    3. not to damage or injure the property. In the event of damage the Licensee will be responsible for the costs of repair;
    4. not to smoke in the Property, or allow any guests to smoke within the Property;
    5. not to keep any pets or animals at the Property, without the Licensor's previous written consent;
    6. not to part with or share possession of the Property;
    7. to only occupy the Property as a private residence;
    8. not to make any alterations or additions, redecorate or paint the Property without the Licensor's previous written consent;
    9. to not do, or permit to be done, anything on or at the Property which may become a nuisance or annoyance to others. This includes, but is not limited to, such actions to the Licensor, other licensees and neighbours.
    10. to forfeit the Property at the end of the Term in the same condition and state as at the beginning of the Term; and
    11. to supply the Licensor with a forwarding address at the termination of this agreement.
  3. The Licensee shall not have exclusive possession of the Property.
  4. The Licensor retains full discretion with regard to the identity of any other occupier of the Property.
  5. Deposit
    1. The Deposit will be held by the Licensor during the duration of this agreement and refunded to the Licensee after the expiry of this agreement, less any reasonable deductions for breach of this agreement. No interest is payable to the Licensee in respect to the Deposit.
    2. The Licensor retains the right to apply any part of the Deposit to cover any reasonable costs incurred as a result of the Licensee's breach of any obligation. In such event, the Licensee shall pay any additional sums required to restore the Deposit to its original sum.
    3. The Deposit will be refunded to the Licensee as soon as is reasonably practical. The Licensor will not retain the Deposit for more than one calendar month, except in exceptional circumstances where the Licensor must determine if there are any sums owed in respect to the Property.
  6. In the event that a substantial proportion of the Property becomes uninhabitable, the Licensee shall be relieved from making the Payment by an amount proportionate to the extent to which the Licensee's ability to live in the Property is inhibited or prevented, except where the damage is due to an act or omission by the Licensee or anybody permitted in the Property by the Licensee.
  7. Where printed, the following is implied:
    1. The "Licensor" includes the successors in title to the Licensor's interest in the Property.
    2. The "Property" includes all of the Licensor's fixtures and fittings in the Property.
    3. All references to the singular shall include the plural and vice versa.
    4. Any obligations or liabilities of more than one person shall be joint and several.
    5. An obligation on the part of a party shall include an obligation not to allow or permit the breach of that obligation.

If there are locks on the door, this may indicate that the tenant has exclusive possession. If not, then an assured tenancy agreement may be a more appropriate option.

Notice of Termination

When serving the notice to terminate this agreement, the landlord has discretion to determine the amount of notice required. It is always best practice to provide this notice in written format, via first-class post with proof of postage for your records.

Execution

Both parties should sign and date by hand where indicated. Next to "Dated:" put the date as of the signature of the last party to sign.
