The landlord access request letter gives Landlords and their agents a useful and easy method of notifying Tenants of the need to enter a rental property. Even though most Tenants are quite content to be notified by phone or email, there are certain tenancies and times when notification requires more formality and service in writing.

Reasons for Entry

The landlord access request letter offers Landlords and their agents the three most common reasons for entry, but also allows for custom reasons for occasions that are out of the norm. It is important to note that a Tenant always has the right to quiet enjoyment of the property, and access should only be sought when necessary, preferably during regular business hours.

Service of Notice to Enter

A Landlord is require to give a minimum of 24 hours' notice prior to entering a rental property. However, it is best practice to give as much prior notice as is practically possible. The landlord access request letter places the responsibility upon the Tenant to communicate to the Landlord or agent if the Tenant does not approve the request to enter. If the Tenant does not respond, then it is within the Landlord's right to enter the property. Note that in the event that the Tenant communicates his or her objection to the Landlord accessing the property, then under no circumstance should the Landlord enter the property. Even in times when necessary works should take place, a Tenant's right to quiet enjoyment must be upheld. It is advisable that this letter is sent by first-class, signed-for registered mail in order to prove delivery and receipt.
